JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,323,332,337,353,367 and 504 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that while the informant and others were submitting applications to the Headmaster for issuance of transfer certificates of their children, accused persons including the petitioner came variously armed when co accused Gautam Singh started firing and pelted stones.

It is submitted by the learned counsel for the petitioner that none received any injury, particularly, fire arm injury.

Patna High Court Cr.Misc. No.13264 of 2015 (2) dt.31-03-2015 2/2 Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent besides the petitioner being accused in Khudaganj P.S. Case No. 177 of 2014 lodged at the same time.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, Hilsa, Nalanda in connection with Khudaganj P.S. Case No.178 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
