Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379, 407, 420, 467, 468, 471, 474 of the Indian Penal Code. It is alleged by a teacher of Bishwanath Thakur Primary-cum-Middle School, Sanri being informant that father of the petitioner namely Satyadeo Mishra was Headmaster of the school who misappropriated the funds of the school. Subsequently Satyadeo Mishra, after his retirement did not return various registers of the school and got this petitioner appointed as teacher.

It is submitted by learned counsel for the petitioner that petitioner never operated any account or handled any financial transaction of the school. A statement to

Patna High Court Cr.Misc. No.46729 of 2014 (2) dt.23-04-2015 2/2 that effect has been made in para 8 of the petition. The complaint was filed by the complainant/informant on 04.02.2010 which came to be registered as police case on 08.09.2013. In fact the accusation has been levelled with a design to become the Headmaster of the school. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that thrust of accusation is against the father of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muger in connection with Tarapur P.S. Case No. 93 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
