Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with Sarsi P.S. Case No. 51/2021, registered for the offence under Sections 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the deceased died due to injuries sustained by her on account of children disputes and the same were inflicted by Barun Mandal and his associates who assaulted her by Lathi and Danda due to which she sustained severe injury but she was not taken to hospital and that occurrence took place one month earlier from the alleged occurrence and thereafter she was treated by the village doctor and she had gone to

During investigation some witnesses named Shashi Kant Mandal and Parmeshwar Mandal supported the petitioner's plea and the F.I.R. was lodged after the delay of three days from the alleged date of occurrence.

Learned Additional Public Prosecutor opposes the prayer for anticipatory bail.

I have heard both the sides and perused the F.I.R. The present case relates to murder. There is serious and specific allegation against the petitioner. According to the prosecution story petitioner and other co-accused persons came at the informant's house and assaulted the deceased by lathi and danda on her head and just after three days the victim died. The case is under investigation, in my view, petitioner does not deserve anticipatory bail. Accordingly, the prayer for anticipatory bail stands rejected. (Shailendra Singh, J) kamlesh/- U T
