JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Pipra Police Station Case No. 283 of 2014 registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 379, and 504 of the Indian Penal Code.

There is allegation against the petitioner no. 2 that he gave Fersa blow on the head of the informant causing injury to him. The aforesaid accusation against the petitioner. No. 2 is corroborated by the injury report of the informant.

No.9922 of 2015 (2) dt.12-03-2015 2/2 So far as rest petitioners are concerned, there is omnibus allegation of assault and the aforesaid accusation of rest petitioners appears to be suspicious. Moreover, there is case and counter case between the parties and persons from both the sides sustained injuries.

Considering the aforesaid facts and circumstances as well as submissions of the parties, except petitioner no. 2, namely, Jitendra Singh@ Munna Singh, all the rest petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari/ concerned court in Pipra Police Station Case No. 283 of 2014, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
