This is second application seeking modification/extension of time to avail the privilege granted to the petitioner vide order dated 21.11.2014 passed in Cr. Misc. No. 21713 of 2014, in connection with Alamganj P.S. Case No. 24 of 2013, pending before the Additional Chief Judicial Magistrate, Patnacity and the same was extended till 23rd January 2015 vide order dated 9th January 2015 passed in Criminal Miscellaneous No. 51510 of 2014.

It is submitted by learned counsel appearing on behalf of the petitioner that Rs.8,000/- (eight thousand) as directed vide order aforesaid has been deposited with the District Legal Services Authority, Patna but due to advance

Patna High Court Cr.Misc. No.6397 of 2015 (2) dt.18-02-2015 2/2 stage of pregnancy of his wife the petitioner failed to surrender. However, now he is blessed with a female child. Taking into consideration all such facts and circumstances, let time to avail the privilege be extended till 18th March 2015, subject to deposit of Rs. 8,000/- (Rs. Eight Thousand only) in Fixed Deposit scheme of any nationalized bank in the name of newly born child.
