1. The present writ petition has been filed seeking the following relief(s):- "1(I) To direct the Respondent No.-4, here in after referred to as Circle Officer, Chanpatiya, District West Champaran to implement and execute his own order, dated 03.03.2022, passed in Encroachment Case No.15/2021-22, whereby and where under he has passed the final order Under Section 6(1) of the Bihar

Patna High Court CWJC No.11286 of 2024(4) dt.18-09-2024 2/3 Public Land Encroachment Act 1956, directing the Private respondents to remove the Encroachment from the land admeasuring an area of 7 dec., 7.1/2 dec. and 9 dec. appertaining to Khata No. 158, Khesra No.

3692/1, 3692/2 and 3692/3, which is public land, wherein construction has been made.

(II) To direct the respondent No.-4, to take appropriate legal action against the Private respondents who are violating the order of encroachment and thus liable to be prosecuted Under section 6(2) of the Bihar Public Land Encroachment Act- 1956.

(III) For a direction to the Sub-divisional Officer, Bettiah Sadar (Respondent No.-3) to take prompt and immediate action on the request of Respondent. No.-4 for vacating the encroachment.

(IV) To direct the Superintendent of Police, west Champaran to immediately provide adequate Police force so that order passed by the Circle Officer, Chanpatiya be implemented in its true letter and spirit."

2. At the outset, the learned counsel for the respondent-State submits that the encroachment has been removed partially and the rest will be removed, within a period of four weeks from today. It is directed accordingly.
