JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,324,307,379 and 504 of the Indian Penal Code.

It is alleged that on the order of petitioner no. 2 Ram Kumar Singh, petitioner no. 4 Raushan and Baburam Singh assaulted with iron rod and Rajendra assaulted with lathi to the informant. When the uncle of the informant Narayan Singh came to rescue then he was assaulted by co accused Pritam (non

No.11783 of 2015 (2) dt.27-03-2015 2/3 petitioner) on the head with Garasa, thereafter petitioner no. 5 Ranvijay Singh and petitioner no. 7 Raghubansh Singh also assaulted with iron rod to the informant and his uncle. It is submitted by the learned counsel for the petitioners that the injury of the informant has been found to be simple caused by hard and blunt substance whereas the accusation of assault to Narayan Singh on his head is against Pritam Singh (non petitioner) and that is the only injury caused to Narayan Singh though opinion has been kept reserved. There is counter version of the occurrence also.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Amba P.S. Case No.40 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
