The petitioner is apprehending his arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

The basic accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the complainant is maternal sister of the petitioner. She was married with Md. Gaffar against whom she

Patna High Court Cr.Misc. No.46778 of 2014 (02) dt.24-04-2015 2/2 filed Complaint Case No. 438C of 2003 which ended into acquittal vide judgment dated 5th of July, 2007. The same has been brought on record as Annexure-2/A and at present the complainant is married with a third person.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Munger in connection with Complaint Case No. 178(C) of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
