The husband of the victim facing accusations punishable under Section 304(B), 201/34 of the IPC has prayed for grant of anticipatory bail.
Within two years of marriage, it is alleged, that the daughter of the informant was done to death in the matrimonial home in suspicious circumstances and the dead body was disposed of . There was allegation of demand of dowry. Counsel for the petitioner submits that the lady was mentally retarded. She suffered from tendency to commit suicide. This factum has come in course of investigation. The petitioner was actually not present at the scene of the occurrence. Learned APP, opposing the prayer, has submitted
Patna High Court Cr.Misc. No.12994 of 2016 (2) dt.08-04-2016 2/2 that in course of investigation witnesses have supported the prosecution case and it was found that she died of burn injuries. Considering the severity of the allegations and the materials reflected from the record including the impugned order, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is rejected. In the event petitioner surrenders and prays for regular bail before the Court below, the same shall be considered on its own merit uninfluenced by the present order.
