JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-03-2016 Heard learned counsel for the petitioner and the State. The petitioner are apprehending arrest in a case registered for the offences punishable under Sections 420, 406, 504 and 34 of the Indian Penal Code.

The F.I.R got registered on the basis of the complaint submitted by Arjun Kumar Prasad in the Janta Darbar of the Chief Minister of Bihar, wherein it has been alleged that the informant received a cheque of Rs. 2,00,000/- from Sri Ram Construction for pursuing the construction work but the said cheque got bounced. On request being made for making the payments, the payments were not made. It appears that learned Sessions Judge, dismissed the anticipatory bail application with cost of Rs. 3,000/- on the ground that the petitioner's anticipatory bail application was

Patna High Court Cr.Misc. No.12490 of 2016 (2) dt.16-03-2016 2/2 disposed of in 2011 by the learned Sessions Judge, but neither the order was challenged before this Court nor the order was complied with.

It is submitted by learned counsel for the petitioner that now the informant has entered into compromise and filed a petitioner to the effect before the learned Court below, hence, present anticipatory bail application has been preferred now. In view of the retracted version of the informant, it is a case of consideration of regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioners, if they surrender within a period of six weeks in connection with Kotwali P.S. Case No. 148 of 2011 pending in the Court of learned Chief Judicial Magistrate, Patna. Accordingly, the application stands disposed of. (Dinesh Kumar Singh, J) sunil/- U T
