2. The petitioner has prayed for bail in a case registered for the offence punishable under section 370 of the Indian Penal Code and sections 3, 4, 5, 6, 7, 8 of the Immoral Traffic Prevention Act and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per allegation in the FIR, employees of Atithi Guest House situated in Phulwarisharif used to allure the girls at the said guest house to take immoral business after calling them. On getting secret information, police surrounded the guest house and manager Ranjit Kumar (petitioner) was arrested on spot and on search victim girls in compromising situation and objectionable items were recovered from the said guest house. Victim girls were disclosed that they were forced by the accused

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Victim girls who were found in comprising situation, are not minor. . Petitioner was simply engaged as Manager of the said guest house. He has not been attributed any specific role in engaging any persons for immoral work. Petitioner has got no criminal antecedent and languishing in judicial custody since Petitioner is in custody since 5.6.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge Excise Patna in connection with Phulwarisharif P.S. Case No. 799 of 2023.
