Mr.Shyam Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-03-2022 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Narayanpur P.S. Case No. 84/2021, registered for the offence punishable under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having tortured and caused death of the deceased victim lady on account of non-fulfillment of the demand for dowry.

The learned counsel for the petitioner has

No.60810 of 2021(2) dt.31-03-2022 2/3 submitted that the petitioner is innocent, he has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 7.7.2021. The learned counsel for the petitioner has further submitted that the petitioner is the father-in-law of the deceased victim lady and the mother-in-law and brother-inlaw of the deceased victim lady have already been granted bail by a coordinate of this Court vide order dated 30.11.2021 passed in Criminal Miscellaneous No. 65548 of 2021. The learned counsel for the petitioner has further submitted that if at all, anybody might be having any complicity in the matter, it is the husband of the deceased victim lady.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the parity

No.60810 of 2021(2) dt.31-03-2022 3/3 of the case of the petitioner with that of the coaccused persons, who have already been granted bail by a coordinate Bench of this Court vide order dated 30.11.2021 passed in Criminal Miscellaneous No. 65548 of 2021, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Bhojpur at Ara in connection with Narayanpur P.S. Case No. 84/2021.
