JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,149,341,323,354,504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

No.47826 of 2014 (3) dt.22-06-2015 2/3 The prosecution case is that when the informant was going for conducting enquiry under MANREGA scheme, the petitioner along with other unknown persons variously armed stopped, abused and assaulted the informant, thereafter on the order of petitioner Kaisu Miyan, 5-10 rounds of firing were made. The accused persons also misbehaved with the female members also. It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general. There is counter version of the occurrence also and four cases were lodged from but the sides for the same occurrence. Statement has been made in paragraph 3 of the petition of petitioner Kaisu Miyan that he has no criminal antecedent whereas statement has been made in paragraph 3 of the petition of petitioner Ram Sagun Rai that he is accused in one other case.

Considering the nature of accusation where no injury was caused, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Barh, Patna in connection with Mokama P.S. Case No. 58 of 2013 subject to the conditions as laid down under
