ANJANA PRAKASH ORAL ORDER 19-08-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in Chanpatia P.S. case No.328 of 2014 registered under Sections 147, 148, 149, 341, 323, 324, 307, 379 of the Indian Penal Code and 25(1-B)a, 26, 35, 27 of the Arms Act, pending before the court of Chief Judicial Magistrate, West Champaran at Bettiah. The Petitioners were allowed anticipatory bail by order dated 29.1.2015 vide Cr.Misc.No.3798 of 2015 but on submission that the Petitioners have fair antecedents. Since there were three other cases pending against the Petitioner No.3 and one other case was pending against the Petitioners No.1 and 2, such an affidavit could not be filed and hence the second application for
Patna High Court Cr.Misc. No.7246 of 2015 (2) dt.19-08-2015 2/2 anticipatory bail.
Since the second application for anticipatory bail is not maintainable, the same is disposed of with a direction to the Petitioners to surrender in the court below which shall consider the fact that the Petitioners on merits was found fit to be released on anticipatory bail.
