ANJANA MISHRA ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.12.2017 in connection with Sakara P.S. Case No.497 of 2017 registered for the offence under Section 399/402 of the Indian Penal Code and Sections 25(1-B)a, 26/35/ 25(1-AA) and 25(1-AAA) of the Arms Act.

Learned counsel for the petitioner submits that on suspicion that the petitioner had assembled to commit dacoity, the petitioner and others were taken into custody. From the possession of the present petitioner, two SIMs were recovered. It is further submitted that the present petitioner has been implicated in few other cases and in all of them, the petitioner

Patna High Court Cr.Misc. No.36599 of 2018 (2) dt.09-07-2018 2/2 was not named in the F.I.R. and has since been granted bail. Considering the aforementioned facts and circumstances and that the petitioner has been in custody for six months past, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-Cum-Sub-Judge 13th, Muzaffarpur, in connection with Sakara P.S. Case No.497 of 2017.
