The petitioner seeks bail in a case registered under Section 392 of I.P.C.

Prosecution case, in short, is that on 21.02.2019 the informant locked courier money of Rs.4,70,000/- in almirah and shutter of the shop was put down and suddenly two persons entered into the shop after lifting the shutter and pointed out pistol and stated to hand over the monty and out of fear he opened the almirah and they put all the cash in the bag kept in the shop and also took laptop and other small items. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.02.2019. Charge sheet has been submitted in this case. There is no allegation of tampering

Patna High Court CR. MISC. No.47029 of 2019(2) dt.30-07-2019 2/2 of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come in the present case merely on the basis that he was seen at the P.O. There is no recovery of any incriminating article from the possession of the petitioner.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Mojahidpur P.S. case No.41 of 2019.
