The petitioner is in judicial custody in connection with Rivilganj P.S. Case No. 256 of 2021 registered under Sections 25(1-b)a, 26, 35 of the Arms Act.

Allegation against the petitioner is that despite the fact that he already has three criminal antecedents, he was caught with loaded country made pistol and live cartridges beside a mobile.

Learned counsel for the petitioner submits that he is a victim of circumstances and he has been in jail since 15.07.2021 (as stated in paragraph 8 of the bail application). He further submits that he is ready to abide by any terms and conditions imposed by this Court, if granted the privilege of bail. In view of the aforesaid facts as also that the chargesheet has already been submitted, let the petitioner be

Patna High Court CR. MISC. No.60570 of 2021(2) dt.18-04-2022 2/2 released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Chapra, Saran in connection with Rivilganj P.S. Case No. 256 of 2021, subject to following conditions:

(i) one of the bailors should be the family member of the petitioner and will produce official document to show his bonafide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence; (iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
