JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 420/406/120B of the Indian Penal Code and Section 138 of the N.I. Act.

The petitioner had received Rs.5,00,000/- as consideration money for transfer of the land. The land was not transferred and petitioner refunded Rs.3,30,000/-. However, he could not refund Rs.1,70,000/- and the Cheque of Rs.1,70,000/- issued by the petitioner in favour of the informant bounced. Thereafter, the petitioner was allowed anticipatory bail in Cr. Misc. No.14468 of 2017, vide Annexure-1, with condition that the petitioner shall refund the remaining amount in five installments.

Patna High Court Cr.Misc. No.36561 of 2018 (2) dt.03-07-2018 P2/ The petitioner did not comply the same. Thereafter, the petitioner was remanded to judicial custody. He is in custody since 24.01.2018.

Considering the facts of the case aforesaid as well as the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bhagwanpur P.S. Case No.156 of 2016, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
