The Petitioner seeks revision of the order dated 16.03.2010 passed in Cr. Appeal No.20 of 2009 passed by the Additional Sessions Judge, Fast Track Court No.6, Sahara, by which he has upheld the order dated 22.08.2009 passed in G.R. Case No.421 of 2003 arising out of Sour Bazar P.S. Case No.72 of 2003 by which the Principal Magistrate, Juvenile Welfare Board-cum-Judicial Magistrate, Saharsa, has refused to declare the Petitioner as juvenile. 2.

During enquiry, the Petitioner produced the document in the name of Indrajeet Kumar Singh saying that he was Indrajeet Kumar Singh. During entire investigation, there is absolutely no whisper that the Petitioner was ever called Indrajeet Kumar Singh. Further, the document appears to have been interpolated. It was on this ground that the Petitioner was not declared as juvenile. The same point was considered by the Appellate Court and the prayer was rejected.

Considering such aspect of the matter, I find no merit in the application. It is dismissed.

The Trial Court is directed to conclude the trial of the Petitioner at the earliest instance without giving unnecessary adjournment to any party. However, the Petitioner shall not be precluded from producing witnesses in support of his age if he so desires.
