JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged two motorcycle borne criminals robbed cash of Rs. 20,000/- from the informant and when the informant made protest, they shot fire at the informant which hit on the neck of the informant. It is submitted by learned counsel for the

The petitioner is not named in the F.I.R and during course of investigation, the petitioner was roped in the present case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the robbery. The petitioner is languishing in custody since 17.01.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Samastipur in connection with Ujiyarpur P.S. Case No. 334 of 2021.
