The petitioners apprehend their arrest in connection with Ramgarhwa P.S. Case No. 65 of 2014 (G.R. Case No. 311 of 2014) registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 379 and 504/34 of the Indian Penal Code pending in the Court of S.D.J.M., Raxaul at Motihari, East Champaran.
The accusation is that at the time of occurrence, the petitioners caused injuries to the informant Shailesh Thakur through lathi, danda and garasa and in that course, all petitioners also caused injury to the brother and father of the informant. Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.47531 of 2014 (2) dt.23-04-2015 2/2 petitioners submits that there is case and counter case of the occurrence in between both the parties. It is also submitted that one Pinki Kumari, the daughter of the co-accused Awadhesh Thakur has filed Ramgarhwa P.S. Case No. 68 of 2014 against the informant and others for the offence under Sections 147, 148, 447, 341, 323, 324, 307, 504, 379 and 506 of the I.P.C. Having considered the facts and circumstances of the case, I am not inclined to allow the prayer of the petitioners for anticipatory bail. Accordingly, the application stands rejected. However, petitioners are directed to surrender before the trial Court within a period of four weeks and pray for regular bail, which shall be considered on its own merit without being prejudiced by the present order.
