Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 379, 427, 511 of the Indian Penal Code and Section 25 (1-b) a/26 of the Arms Act.

Allegation is that a pistol was recovered by the people from possession of the petitioner. However, the petitioner managed to escape.

Submission is that the recovery and production of firearm by private person is punishable under Section 37 of the Arms Act, which is bailable one. The petitioner is in custody since 28.03.2018. Investigation of the case is already complete.

No.35510 of 2018 (2) dt.27-06-2018 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kisanpur Police Station Case No.317 of 2017, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
