Petitioner is in custody in connection with Kaluahi 83 of 2019 for the offence under section 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He submits that in the instant case total 360 liters of nepali wine was seized. Learned counsel submits that petitioner is in custody since 15.6.2019 and nothing was recovered from the conscious possession of the petitioner.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.49200 of 2019(2) dt.07-08-2019 2/2 let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II cum Special Judge Excise Act, Madhubani, in connection with Kaluahi 83 of 2019, G.R. No. 1074 of 2019.
