JUSTICE SUDHIR SINGH ORAL ORDER 20-05-2015 The petitioners are apprehending their arrest in connection with Muffasil P.S. Case No. 203 of 2013 for the offences instituted under Sections 420, 465, 466, 467, 468, 470 and 471 of the Indian Penal Code.
Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that on 12.09.2013 at 12.30 P.M., accused Sheo Kumar came to Anchal Office whose application for grant of land possession certificate was verified by the Revenue Karamchari and Circle Inspector, Jagarnath Choudhary. They had reported that the receipt submitted by him was forged. The rent receipt was also got verified from Anchal Nazir who reported that no such rent receipt was issued from the
Patna High Court Cr.Misc. No.48522 of 2014 (3) dt.20-05-2015 2 / 3 Register and the receipt was forged. The written report also reveals that three applications respectively at Sl. Nos. 301209, 301210 and 301211 of dated 06.09.2013 were filed by the accused Sheo Kumar.
It has been submitted on behalf of the petitioners that the petitioners are not named in the F.I.R. Further it has been submitted that the petitioners have no criminal antecedents. It is further submitted that the petitioners have no concern with the land in question. Further it has been brought to the notice vide Annexure-2 that co-accused, namely, Madhu Devi has been granted anticipatory bail by this Court vide Cr. Misc. No. 12188 of 2014.
On behalf of the State, it has been submitted that the petitioners have specific role in committing the fraud upon the informant.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of eight weeks from today in connection with Muffasil Case No. 203 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Munger, subject to the
Patna High Court Cr.Misc. No.48522 of 2014 (3) dt.20-05-2015 3 / 3 conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
