Patna High Court CWJC No.14629 of 2023 dt.27-03-2024 2/2 was disqualified and not called for the final consideration, is the grievance. The petitioner approached the District Magistrate and the Development Commissioner, but without any avail.

2. The learned Counsel for the respondent authority points out from Annexure-1, Notice Inviting Tender that the tender was only for the period of 2023-24, which was awarded to the 12th respondent. The tender comes to an end on 31.03.2024 and there is also a fresh tender issued as of now.

3. The learned Counsel appearing for the 9th respondent- Nagar Panchayat also submits that the 12th respondent's work order has not been challenged in the writ petition.

4. Considering the totality of the circumstances, we are of the opinion that the writ petition itself has become infructuous and we dismiss the same.
