Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

The petitioner seeks anticipatory bail in connection with Mufassil P.S. Case No. 173 of 2021, registered for the offence under Sections 409, 420/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner's truck was hired for transportation of the paddy from Gurmaha godown which is clear apparent from the FIR and in respect of other allegation concerned to the alleged offence under Section 409 IPC, petitioner's any role has not been revealed and regarding the transportation of the said paddy by

Patna High Court CR. MISC. No.61005 of 2021(2) dt.07-06-2022 2/2 the petitioner's vehicle sufficient relevant documents have been filed and petitioner is the owner of the said truck and the alleged offence under Section 420 is also not attracted against him in this case.

Learned APP has vehemently opposed the prayer for anticipatory bail of the petitioner.

Having Considered the above submissions and the annexure-3 series filed by the petitioner which are relevant to his submission, let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Mufassil P.S. Case No. 173 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
