JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Earlier prayer for bail of the petitioner was rejected twice by this Court vide order dated 18.1.2017 passed in Cr.Misc.No.47325 of 2017 and vide order dated 2.8.2017 passed in Cr.Misc. No. 36325 of 2017.

Submission of learned counsel for the petitioner is that by last rejection order the trial court was directed to conclude the trial within a period of nine months but the trial has not been concluded and similarly situated co-accused has been granted bail by a coordinate Bench of this Court vide order dated 2.8.2017 passed in Cr.Misc.No. 23213 of 2017 and except that petitioner was last seen with the deceased there is absolutely nothing against the petitioner.

No.36657 of 2018 (2) dt.27-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 9th Additional District and Sessions Judge, Muzaffarpur, in connection with Sessions Trial No. 130 of 2017, arising out of Kanti P.S.Case No. 475 of 2015, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
