JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Agiaon Bajar P.S.Case No. 53 of 2014 registered for the offences punishable under Sections 341, 323, 324, 307, 504, and 506/34 of the Indian Penal Code.

Petitioners are named in the first information report with allegation that petitioner no. 2 gave Rami blow to the informant causing injury near his ear and so far as petitioner no. 1 is concerned, omnibus allegation of assault has been leveled against him. The impugned order of learned Sessions Judge reveals that both the injured have sustained simple injuries

Patna High Court Cr.Misc. No.10377 of 2015 (2) dt.17-03-2015 2/2 caused by hard and blunt substance but the case has been registered under section 307 of the Indian Penal Code. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Arrah in Agiaon Bajar P.S.Case No. 53 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
