The petitioner being cousin of the informant is apprehending arrest in a case registered for the offences punishable under Sections 406/420/467/468/323/504/379 of the Indian Penal Code.
It is alleged that the petitioner is not vacating the ancestral house which fall in the share of the informant as per the family partition in spite of the fact that the informant is ready to make payment of the agreed amount of Rs.1,50,000/-. It is also alleged that when request was made to vacate t hen the petitioner assaulted the informant and his son. Co-accused Anil Yadav snatched wrist watch from the hand of the complainant whereas co-accused Dinesh Yadav snatched
Patna High Court Cr.Misc. No.11428 of 2015 (2) dt.28-04-2015 2/2 Rs.1,000/- from the pocket of the complainant. It is submitted by learned counsel for the petitioner that in the background of partition dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Jhajha P.S. Case No.150 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
