JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-03-2015 The matter has been listed for hearing out of turn on the administrative order of Hon'ble the Chief Justice since the petitioner has to appear at the Matriculation examination. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 324, 341, 506 and 307/34 of the Indian Penal Code.

It is alleged that the informant went to attend the birthday party on the invitation of co-accused Abhimanu whereas this petitioner and co-accused Chhotu assaulted the informant. The impugned order suggests only one injury on the parietal region of the informant which has been found to be simple. A statement to that effect has been made in para 5 of the petition.

Considering the fact that only one injury has been found on the parietal region of the informant which has been found to be simple when the accusation of assault is against two persons, let the above named petitioner be released on anticipatory
