In view of the admitted position that warrant of arrest has not been issued in the concerned complaint case and in view of the decision dated 14.05.2015 of a Single Judge Bench of this Court rendered in Salim Ansari & Ors. Vrs. the State of Bihar & Ors. (Criminal Miscellaneous No.51075 of 2014), this application would not be maintainable, learned counsel for the petitioners seeks leave to appear before the court below which has issued the summons.

Accordingly, this application stands disposed of with
