The petitioners apprehend their arrest in Naw Kothi P.S. Case No. 132 of 2015 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code and under Sections 3/4 of the Prevention of the Witch (Daain) Practices Act. The petitioners are alleged to have called Jasoda Devi in her house but thereafter she became traceless. After enquiry the petitioner and his family members are said to have disclosed that mother of the informant had gone to market after taking money from them. On the next day the headless body of the mother of the informant was found. Isamul Mian disclosed that Sabbir Alam and Alizan Mian had parked motorcycle in the night. The petitioners and their family members were making allegation of practicing
Patna High Court Cr.Misc. No.19869 of 2016 (4) dt.18-07-2016 2/2 witch craft on her grand-daughter.
It is submitted that the blood stained shirt was found from the dickey of the motorcycle of Alizan Mian which was sent for forensic science laboratory and the scientist reported that the blood of animal was found in the shirt.
It appears that it was the petitioners who called the lady and thereafter the lady became traceless and on the next day her headless body was found.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected.
