The petitioner has preferred this application for grant of regular bail in a case registered under sections 461, 379 and 34 of the Indian Penal Code.
As per the prosecution case, various articles were stolen after making a tunnel. It is further stated that on search all around, one of the accused was seen making an attempt to escape on a motorcycle but was caught and it was the petitioner. Further on his disclosure other stolen articles were recovered from the house of the coaccused.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. He was caught under misunderstanding. He is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation, the petitioner having remained in custody for over 1 year and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Araria P.S. Case no. 275 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria (Partha Sarthy, J) Bibhash/- U
