The petitioner apprehends his arrest in Warisnagar P.S. Case No.146 of 2019 registered under Section 30(a) and 38 of Bihar Prohibition and Excise Act.

The police searched a Bolero Jeep bearing registration No.BR01PB-3111 and recovered 32 bottles of Imperial Blue Whiskey each containing 180 ml. from the vehicle. The learned counsel for the petitioner submits that petitioner is driver of the vehicle and he had no knowledge about the liquor being kept in the vehicle but it appears that it was petitioner who had brought the vehicle and after seeing the police, the petitioner fled away. From the vehicle, 32 bottles of Whiskey were recovered.

Patna High Court CR. MISC. No.47249 of 2019(2) dt.30-07-2019 2/2 Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
