Petitioner apprehends arrest in registered for the offences punishable under Sections 379, 506/34 of the Indian Penal Code.

As per prosecution case, this petitioner along with other accused persons assaulted the informant and snatched cash and golden jewellery.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to land dispute. Both parties are agnets. It is further that the date of alleged occurrence is 17.09.2019 and F.I.R. for the same was instituted on 30.09.201 and that itself falsifies the prosecution case.

Patna High Court CR. MISC. No.51099 of 2022(2) dt.19-12-2022 2/2 Learned counsel for the State opposes the prayer for bail application submitting that there is specific allegation of assault against this petitioner and he has got 4 criminal antecedents.

Considering the nature of accusation and 4 criminal antecedents of the petitioner, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
