Petitioner apprehends his arrest in connection with Riga P. S. case no. 287/2014 registered under section 307 and other allied sections of the IPC.
There is allegation against the petitioner that he put Gamcha around neck of the informant and pulled the same with an intent to commit his murder. Annexure 2 to this petition reveals that injury on the neck of the informant was found, though said injury is simple in nature.
Learned counsel for the petitioner submits that both parties have entered into compromise.
Considering the facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on anticipatory bail and accordingly, his prayer for anticipatory bail in
Patna High Court Cr.Misc. No.7314 of 2015 (2) dt.26-02-2015 connection with the above stated case stands rejected. However, if the petitioner surrenders before the Chief Judicial Magistrate, Sitamarhi/ concerned court in the above stated case within four weeks from today and seeks regular bail, his regular bail application shall be disposed of on its own merit without being prejudiced by this rejection order, particularly, keeping in mind the factum of compromise.
