Patna High Court Cr.Misc. No.14091 of 2016 (2) dt.20-04-2016 2/3 SHARAN SINGH ORAL ORDER 20-04-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Chainpur P.S. Case No.203 of 2015, disclosing offences under Sections 147, 149, 153(A), 295(A), 296, 298 and 353 of the Indian Penal Code. Learned counsel for the petitioners has produced before me a copy of the order, dated 01.04.2016, passed in Cr. Misc. No.7851 of 2016, whereby, similarly circumstanced co-accused persons have been granted anticipatory bail, by this Court. Upon perusal of the said order, I find that there is no distinguishable feature in the case of the present petitioners and the petitioners of said Cr. Misc. No.7851 of 2016.

This application is, accordingly, allowed. Let the petitioner Nos.1 to 7, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua,

Patna High Court Cr.Misc. No.14091 of 2016 (2) dt.20-04-2016 3/3 in connection with Chainpur P.S. Case No.203 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner Nos.1 to 7, abovenamed, shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
