JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Punpun P.S. Case No. 120 of 2018, Special Case No. 4477 of 2018 for the offenses under Sections 273 IPC and 30(a) of the Bihar Excise and Prohibition Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 12.5.2018. It is further submitted that petitioner has been made accused in this case on the ground of suspicion. The petitioner was the driver of the auto/tempo in which the alleged country made Mahua liquor was recovered.

Considering the fact that the petitioner has no criminal antecedent and he has remained in jail for more than one month,

Patna High Court Cr.Misc. No.36103 of 2018(2) dt.28-06-2018 2/2 let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Punpun P.S. Case No. 120 of 2018, Special Case No. 4477 of 2018.
