ANJANA PRAKASH ORAL JUDGMENT Date: 17-03-2015 The petitioner seeks quashing of the order dated 22.02.2003 passed by the Special Judge, Vigilance (South Bihar) Patna in Magadh University P.S. Case No. 64 of 2000. On the last occasion this Court had summarized two-fold allegations with regard to the petitioner in the following manner :- (i) The first allegation is that he was approached by the S.P. to be lenient in the examination of his wife who was appearing for M.A. Examination. There is no further material that the Petitioner told the Centre Superintendent to be lenient. Nor is there any material that the Petitioner in any manner

Patna High Court Cr.Misc. No.44746 of 2011 dt.17-03-2015 2/2 facilitated unfair means for the said examinee. (ii) The second allegation is that the said lady was appointed as a Teacher flouting the procedural rules.

Today the counsel for the vigilance is unable to satisfy this Court that there is any material in support of the aforesaid two grounds.

In view of such , the application is allowed. The order dated 22.02.2003 passed by the Special Judge, Vigilance (South Bihar) Patna in Magadh University P.S. Case No. 64 of 2000, is hereby quashed so far as the petitioner is concerned. (Anjana Prakash, J) Prakash/- U T
