There happens to be an allegation against the petitioner to have deceived the complaint of Rs. 51,000/- in lieu of purchasing policy of Birla Sun Life Insurance which was never purchased. Furthermore, it has also been disclosed that on repeated demand a cheque was issued by the petitioner which was dishonoured.
During course of submission, learned counsel for the petitioner submits that petitioner is ready to deposit the amount and for that, installments be fixed.
On deposit of Rs. 30,000/- within four weeks from the date of receipt/production of order, petitioner Sunil Kumar
Patna High Court Cr.Misc. No.12421 of 2016 (2) dt.31-03-2016 2/2 Srivastava would be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., IX, Arrah in connection with Sandesh P.S. Case No. 02 of 2015 in event of her arrest or surrender within four weeks from the date of receipt/production of the order in terms of condition so enumerated under Section 438(2) of the Cr.P.C. Remaining Rs. 21,000/- must be deposited within four weeks furthermore. In case of fault at the end of the petitioner, the privilege so allow will cease to survive otherwise, the provisional bail will be confirmed by the learned lower Court itself.
