JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 379, 504 and 307/34 of the Indian Penal Code.
It is alleged that the accused persons including the petitioner came variously armed when brother-in-law of the petitioner namely Shamim and Madan Yadav caught hold of the informant, brother-in-law of co-accused Jhamul snatched ornaments worth `15,000/-, Shamim took out Rs. 45,000/-, coaccused Jhamul assaulted with iron rod on the head of the informant, thereafter, Azimul assaulted the informant with lathi. It is submitted by learned counsel for the petitioner that no overt act has been alleged against the petitioner. The accusation of assault and snatch has been levelled against Azimul, though, the
Patna High Court Cr.Misc. No.11575 of 2015 (3) dt.30-03-2015 2/2 injury has been found to be grievous. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Purnea Sadar P.S. Case No. 634 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
