The petitioner is apprehending his arrest in connection with Barsoi P.S. Case No. 208 of 2015 for the offences instituted under Sections 147, 148, 149, 323, 324, 307, 447, 427, 379, 504 and 506 of the IPC.

The prosecution story, in brief, is that on the alleged date and time of occurrence, the petitioner and others, having armed with deadly weapons came to the house of the informant and after demolishing the thatched house of the informant, started taking away the same. On the protest raised by the informant, petitioner gave Dabiya blow on the head of the informant, as a result of wich, he sustained injury on his head. Petitioner again attacked

Patna High Court Cr.Misc. No.15675 of 2016 (2) dt.13-05-2016 2/2 with Dabiya which was warded off and his hand was injured. The accused persons are also alleged to have snatched away Rs. 30,000/- from the pocket of the informant.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is an admitted land dispute between the parties. It is a case and counter case between the parties. The injury on the part of the petitioner's side has not been explained by the prosecution. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Barsoi P.S. Case No. 208/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
