The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 384, 406, 420, 467, 468, 471, 504 and 34 of the Indian Penal Code.

Prosecution case is that the petitioner took rupees three lakhs for getting the informant employed abroad. Though, the informant was sent on tourist Visa to Malaysia but he was not allowed to work there. On being returned from Malaysia, the petitioner demanded back money but the same was not returned.

It is submitted by learned counsel for the petitioner that in fact fifty thousand rupees was only transferred in the account of the petitioner and there is nothing on record to

Patna High Court Cr.Misc. No.14277 of 2016 (2) dt.01-04-2016 2/2 suggest that the petitioner assured for providing employment to the informant abroad. However, the petitioner is ready to return rupees fifty thousand to the informant, which has been transferred in his account.

The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Gopalganj P.S. Case No.58/2014, pending before the learned CJM, Gopalganj. With the above observation, this application is, accordingly, disposed off.
