Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 341, 342, 323, 307, 302, 354 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that from the First Information Report, it would appear that there are altogether 7 accused persons against whom the allegation is that they entered in the house of the deceased Mithilesh in inebriated condition. Learned counsel submits that so far as the allegation of assault is concerned, it is specifically made against the co-accused Biru and Rajeev who are said to have assaulted the deceased on his head because of which he fell down and ultimately died.

Patna High Court Cr.Misc. No.37715 of 2018 (2) dt.10-07-2018 2/2 Leaned counsel submits that so far as the present petitioner is concerned, there is no specific allegation of committing any overt act against him.

Learned Additional Public Prosecutor for the State is present.

Considering the facts and circumstances of the case whereunder it appears that specific allegation of assault is against co-accused Biru and Rajeev and that the petitioner has got no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ashok Paper Mill Police Station Case No. 18 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
