====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 15-11-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Jale P.S. Case No. 83 of 2025 dated 20.04.2025 registered for the offences punishable under Sections 105, 238 of the B.N.S., 2023 and Section 27 of the Arms Act.

As per the prosecution case, on 20.04.2025 at about 8.15 A.M., the informant received telephonically an information that in course of rituals of 'Haldi' of Rajan Kumar Singh (petitioner) who is the son of Ram Vinay Singh, on 1920.04.2025, in the night, during the course of dance programme performed by the lady dancer on the stage, Ram Vinay Singh, Rajan Kumar Singh (petitioner), Ranjan Kumar Singh, Anita
2/4 Devi and the other brothers, relatives and friends of Ram Vinay Singh intentionally fired on the said lady dancer, due to which, she received injury and thereafter she thrashed on the ground. She was taken to the hospital with the help of other dancers and known persons. It is further alleged that at the place of occurrence, in the Samiyana, which was standing on the stage, several holes and burnt which was caused due to firing was found. The local Choukidar, respectable villagers and police supported the alleged occurrence. It is further alleged that in the said occurrence, apart from the aforesaid persons, Amit Singh, Prabhat Singh who are the friends of Rajan Kumar Singh (petitioner) and 8-10 friends and relatives were also involved who were firing at the place of occurrence, due to which, dancer, Shanu Khan @ Aayasha received firearm injury in her stomach, due to which, she died in D.M.C.H., during the course of treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the informant who is the Station House Officer is not the eye witness to the alleged offence rather on secret information, he reached the place of occurrence and recorded his self statement on the basis of information given
3/4 by the local persons. It is further submitted that during the course of investigation, statement of the several witnesses was recorded under Section 180 of the B.N.S.S., 2023 in which they have stated general and omnibus allegation against the petitioner. There is no specific allegation of firing on the deceased against the petitioner. It is further submitted that Prabhat Singh @ Little had fired which hit the deceased. The petitioner and his family members have no concern with the alleged offence. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody in this case since 22.04.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Darbhanga, in connection with Jale P.S. Case No. 83 of 2025 with further condition:- (I) The petitioner is directed to remain physically present before the learned court
4/4 below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
