JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 3797 of 2018 arising out of Danapur P.S. Case No. 227 of 2018 for the offences under Sections 457, 380, 511 IPC and Section 37(b) of the Bihar Prohibition and Excise Act,2016.

Allegation against the petitioner is that he has drunken wine and entered the house of the informant for the purpose of committing theft.

Learned counsel for the petitioner submits that petitioner has remained in custody for more than two months and he has no criminal antecedent.
