JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-11-2019 At the outset, the learned counsel for the petitioner seeks to make correction in the depiction of the father's name of the petitioner and the address given in the cause title. Let the same be done during the course of the day.

Heard the learned counsel for the petitioner and the learned APP for the State.

This is an application for grant of anticipatory bail in connection with Ashok Paper Mills P.S. Case No. 116 of 2018, registered for the offence punishable under Sections 307, 120(B) and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation is regarding the co-accused person namely, Manoj Kumar Thakur, having shot on the brother of the informant resulting in firearm injury to the brother of the

Patna High Court CR. MISC. No.50385 of 2019(4) dt.20-11-2019 2/2 informant. It is further alleged that the accused persons had, after shooting the brother of the informant, fled away. The learned counsel for the petitioner has submitted that the said co-accused namely, Manoj Kumar Thakur, who is said to have shot upon the brother of the informant, has already been granted bail by a coordinate Bench of this Court vide order dated 25.6.2019 passed in Criminal Miscellaneous No. 14293 of 2019. The petitioner is stated to be having a clean antecedent.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Ashok Paper Mills P.S. Case No. 116 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
