The petitioner seeks bail in Bairiya P.S. Case No. 74 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner along with co-accused persons outraged the modesty of informant's daughter and got terminated her eight months pregnancy by operation.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. Both parties are close relative. Informant is full sister of co-accused Sushil Chaudhari and petitioner is son of the sister of informant and own nephew (Bhanja) of co-accused Sushil Chaudhari. In fact, there is land dispute between the parties and informant is

Patna High Court CR. MISC. No.60692 of 2021(3) dt.29-03-2022 2/2 demanding share in her paternal property. The victim is married lady and her age has been assessed as 18-19 years. Petitioner is in custody since 14.03.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S.
