This is an application seeking modification/extension of time to avail the privilege granted to the petitioners vide order dated 11th April, 2013 passed in Cr. Misc. No. 51000 of 2012 in connection with Laheriasarai P.S. Case No. 147 of 2010, pending before Chief Judicial Magistrate, Laheriasarai at Darbhanga.

The petitioners, instead of surrendering before the court below and taking advantage of the provisions as contemplated under Section 446 of the Code of Criminal Procedure, appear filing an application seeking report from the S.D.O., Darbhanga about his deputation of the bodyguard and apparently have been awaiting for the report for last two years.

In view of the above, there appears no reason to extend the period to avail the privilege so granted. Accordingly, the prayer of the petitioners is hereby refused.

No.10396 of 2015 (2) dt.11-03-2015 2/2 The petitioners are directed to surrender before the court below immediately seeking regular bail, failing which, the court below may take all coercive steps against the petitioners to secure their appearance/apprehension at the earliest.
