The Petitioner seeks quashing of the order dated 9.8.2010 passed by the 3rd Additional Sessions Judge, Chapra, in Criminal Revision No. 142 of 2010 by which he has set aside the order dated 15.5.2010 passed by the Judicial Magistrate, 1st Class, Chapra in Trial No. 1614 of 2010 arising out of Complaint Case No. 1577 of 2009 by which he has allowed the petition under Section 205 Cr. P.C.

On the last occasion, a report was called for from the Trial Court with regard to the stage of Trial from which it appears that now charges have been framed and one witness has also been

In view of such, I see no justification for interference in the matter.

The application stands dismissed.
